Aircraft Accidents Compensation

I'm wondering if there is a minimum compensation for the surviving family members of those involved in aircraft accidents.

In the ICAO Policy, it's stated:

For every aircraft accident, there are five groups involved to provide family assistance. According to the ICAO Policy, these are:

a) the government of the State of Occurrence and other States involved in the occurrence;
b) the air operators;
c) the airport operators;
d) third parties (e.g. non-governmental aid agencies, commercial companies); and
e) family associations, when required.

These parties are geared towards different assistance efforts, but their effective coordination is very essential. The Council also recommends that a family assistance plan should take into consideration the following factors:

a) recipients of family assistance;
b) types of family assistance to be provided;
c) when family assistance should be provided;
d) family assistance providers;
e) periodic review and exercise of the plan; and
f) enactment of legislation, regulations and /or policies necessary to implement the plan


Aircraft accidents are particularly horrifying and devastating. Just one mechanical failure (failing to review full scale full scale aircraft models or concurring to pending design change), or a small pilot error such as failing to program the FMC... and many lives will be lost.

For international air travel, liability is regulated by the Montreal Convention, which replaced the Warsaw Convention.

Article 21 details compensation for death. The definition of the Special Drawing Right is in article 23.

Thanks for this I actually reviewed it too. Montreal Convention best protects the people without the previous need to prove the neglect of the airline companies/manufacturers.
