SAA ordered to pay R1 bln (USD $72Mil) in damages to Comair

The High Court in Johannesburg ordered SAA to pay more than R1 billion (USD $72mil) in damages to Comair for anti-competitive conduct.

Case revolved around SAA’s anti-competitive travel agent incentive schemes. The scheme, which was in place from 2000 to 2005, was designed to keep travel agents loyal to SAA. The national carrier paid them to divert customers to it, rather than rival airlines. The Competition Tribunal found that this violated the Competition Act.

Cash-strapped SAA wants the amount to be reduced to just over R300 million. In papers before the SCA, SAA argues that the High Court was correct to award damages to Comair. But it wants the amount reduced, claiming the High Court’s decision was based on inadequate facts.

Money SAA does not have.

Also amazing how slow the court system functions in SA.

This is fairly rational ... the Competition Tribunal determined a fine, which is challenged in the High Court and then appealed to the Supreme Court. How is it amazing? It's a near identical system to the UK and Australia whose competition law South Africa is based on.

It takes 16-years for cases to make their way through the courts in SA? :scratchchin:

As article states Comair filed complaint about this back in 2003 !
With such long time frame many companies could have gone out of business making case a judgment meaningless.

I don't think the article gives the full picture. Comair first made a complaint in 2003 which was decided by the Competition Tribunal in 2010. SAA appealed and lost on this in 2011.

They subsequently made another complaint in 2008 and then again in 2011. These two were joined together, and decided by the Competition Tribunal in 2017. This current appeal refers to these later two complaints.

Another billion Rand found out of thin air here in SA....the numbers simply don't add up anymore. What are Moody's an S&P upto?

What a slow legal process. Comair could be out of business if it must wait so long to get justice for SAA's unfair market practices.
