Its rather simple argument to make you are on duty for a company for X hours however you are only compensated for Y hours. It's hard to see how 9th Circuit or the SCOTUS will rule against this. Once the current leases begin to expire on the 717s, I see Boeing being very aggressive on pricing to keep those 88 birds wearing the widget. DL will get a smoking deal from Boeing without question.. whether DL will take it is another story.
